What are the building setbacks for a particular property?

Building setbacks for undeveloped lots in Residential Districts in Brewster are set at 40' from the street lot line, and 25' from the side and rear lot lines. Building setbacks for residential properties that are already developed may vary and are based on the date that the most recent plan or subdivision plan for the lot was approved by the Brewster Planning Board. You are responsible for confirming the date of board approval for your property; this is typically done through an inquiry at the the Barnstable County Registry of Deeds. Once you have done so, you may ask the Building Department to confirm the setbacks for your developed property.  Please be advised that unless a completed building permit application is received, the Building Commissioner cannot determine the 'buildability' of any given lot.

For both developed and undeveloped properties, there may be other factors limiting the size and/or location of a proposed structure including, but not limited to: 

1) Proximity to Wetlands (whether on the locus property or not)

2) Inclusion in one or more Water Protection Overlay Districts

3) The presence of Wetlands Conservancy Soils where a proposed structure is to be located

4) Building coverage limitations (see Brewster Zoning Chapter 179 Table 3, Height and Bulk Regulations)

5)  Setbacks to existing septic system components or underground utility structures

6) Approval of the project by the Old King's Highway  ('OKH') Historic District Committee if the subject property is within the OKH District

7) Approval by the Health Department for septic system requirements

8) If the intended Use of the proposed structure is not permitted in the Zoning District in which the property is located
